Judge: BP contract shielded Transocean in spill (AP)

NEW ORLEANS ? The rig owner involved in drilling the ill-fated well that blew out in the Gulf of Mexico and spewed more than 200 million gallons of oil will not have to pay many of the pollution claims because it was shielded in a contract with well-owner BP, a federal judge ruled on Thursday.

The decision may have spared the driller from having to pay potentially billions of dollars. However, U.S. District Judge Carl Barbier said that Transocean still is not exempt from paying punitive damages and civil penalties that arise from the April 20, 2010, blowout 100 miles off the Louisiana coast.

The ruling comes as BP, the states affected by the disaster and the federal government are discussing a settlement over the nation's largest offshore oil spill. The Justice Department is working with the states to create an outline for a settlement that would resolve their potentially multibillion dollar claims against BP and the other companies involved in the disaster, Alabama Attorney General Luther Strange told The Associated Press.

Justice led a meeting last week in Washington among the states in an effort to formulate an agreement that would satisfy government and state claims, including penalties and fines, Strange said. He also indicated if there is a settlement that officials are discussing what to do with the $20 billion fund set up by BP to pay victims.

A first phase of the trial is set for Feb. 27 to determine liability for the spill.

Despite the setback, BP claimed victory and said Barbier's ruling "at a minimum" left Transocean facing "punitive damages, fines and penalties flowing from its own conduct."

Blaine LeCesne, an associate professor at Loyola University law school, however, said Barbier's ruling was a "major victory" for Transocean.

"If anything is going to compel the parties toward settlement, it's going to be this," he said. "I think BP is in a very bad position now, and they don't have a lot of leverage."

BP PLC, Transocean Ltd. and Halliburton Co. have been sparring over who was at fault for causing the blowout. The out-of-control well was capped in July, 2010. Federal investigators have said that BP bears ultimate responsibility for the spill, but has faulted all three companies to some degree.

Under a drilling contract, BP and Transocean agreed to indemnify each other in the case of an accident, with BP taking responsibility for pollution originating from the well and Transocean for any pollution or accidents aboard the rig.

However, in court BP argued that the contract did not shield Transocean if the drilling company acted in manner that was grossly negligent.

Barbier, though, largely sided with Transocean and said the contract was a "clear and unequivocal agreement" to provide "broad indemnity."

"As we have said from the beginning, Transocean cannot avoid its responsibility for this accident," BP said.

The British oil giant said it had "stepped up" and admitted its role in the spill and paid billions of dollars in claims.

'I Just Want My Pants Back' Cast Calls 'Jersey Shore' 'A Great Show'

'Pants Back' cast throws a party in Brooklyn to celebrate the show's much-anticipated premiere on February 2.

NEW YORK — On Thursday night, the cast of MTV's latest scripted comedy, "I Just Want My Pants Back," gathered at the Public Assembly in Brooklyn, where they not only celebrated the show's imminent arrival, but also got to hang out with their Thursday night cohorts, the cast of the "Jersey Shore."

The pilot for the series originally got some love when it made its debut after the VMAs in August, and now it will officially kick off its run next Thursday. The cast, it seems, can't wait to finally have it on air.

"At last! I know everyone's been asking," Jordan Carlos joked to MTV News about the long-simmering delay. "My parents can finally get off my back; it's real. It'll be on on Groundhog Day, which happens to be my birthday as well."

"We've been seeing the commercials for the show for years now," Sunkrish Bala teased. "Slow burn, but it's all coming to a beautiful conclusion right now."

"It feels so crazy to be here right now," co-star Kim Shaw said. "We wanted people to see it at the VMAs to give people a taste of what we were filming, and now that we're finished with the series, we're so excited that everyone gets to see the whole thing."

Having already had one very high-profile premiere, it seems that next week it will get one more thanks to the "Jersey Shore" as its lead-in. "It's awesome." Elisabeth Hower said. "The fact that the network has so much confidence around us really means a lot, and I think that says a lot about the show. Please watch the show. We're nice people."

"It's an amazing lead-in," said Peter Vack, leading man of "Pants Back." " 'Jersey Shore' is a great show."

While the "Jersey Shore" and "Pants Back" may seem like different shows on the surface — one's scripted, one's a reality show; one's about hipsters, one's about guidos — they both deal with a group of friends navigating their love lives. "Pants Back" follows a group of twentysomethings in New York City as they pilot love, friendship and the job market with a good dose of dirty humor and some heart thrown in for good measure.

"The show just goes so many fun places," Vack teased. "It's just a crazy ride, and I'm excited for people to take the ride with us."

"Pants Back" premieres on February 2 at 11 P.M. ET/PT right after the "Jersey Shore."

Minn. bear delivers at least 2 cubs on Internet (AP)

ELY, Minn. ? A 3-year-old bear in Minnesota has given birth to two cubs before an Internet audience.

Lynn Rogers of the Wildlife Research Institute, affiliated with North American Bear Center, said in a news release that Jewel gave birth in a den near Ely to the first cub at 7:22 a.m. Sunday, and a second at 8:40.

It's not the first time Rogers and his colleagues have monitored hibernating pregnant black bears.

In 2010, they recorded the birth of a bear named Hope in 2010. A Hunter killed Hope last year.

Jewel is the younger sister of Hope's mother, Lily.

Lily also gave birth last year to two cubs named Faith and Jason.

Dear Pinnochio's Grandma,

There's nothing quite as charming as a straight-faced 4-year-old telling you about the trip they took to the moon on the back of a talking kangaroo while they ate candy that the Easter bunny gave them for the trip. One of the most endearing qualities about children this age is the fact that they have one foot in reality, and one firmly in the world of fantasy. A 4-year-old can look you in the eye and tell you they had nothing to do with that missing piece of cake with a face smeared with chocolate. Instead of scolding your granddaughter for "lying," try these strategies:

Don't use logic as a way to "catch" your granddaughter being dishonest. "No, you didn't talk to Santa on the phone about how granny was naughty for not letting you have candy for dinner!" Enjoy the moments when your little one weaves those far-fetched stories as proof that she is still, thankfully, living at least part-time in the world of her imagination.

Make it clear that some topics require her to be accurate with her facts. Try saying things like, "I know it may be uncomfortable to tell Grandma that you had an accident in your pants, but I have to know, and I promise that I won't get mad." Or "I know it's scary to tell your Daddy that you took your brother's action figure because he wouldn't let you play with it, but I will be less upset if you tell me than if you try to hide it..."

Make it safe for your granddaughter to confess to doing something she shouldn't have done. If she believes that she'll be hurt -- physically or emotionally -- when she does tell you the truth, you will essentially "teach" her that twisting the facts pays off.

Channel some of your child's creative juices into story-telling. Encourage her to narrate into a recorder. This activity will give her the thrill of hearing her imagination take flight. Help her understand that there's a time and a place where it's absolutely fine to play make-believe so she doesn't think that she can never wander in her fantasy world.

Preschoolers need to know that when you say, "Tell me what really happened", they must reach for the truth, but they also have to know that it's safe to reveal it. Just keep in mind that they are still at a stage where the truth is often mixed up with make-believe. So, don't come down too hard when your granddaughter tries to convince you that the fairies really did give her the chocolate bar that looks very much like the one that's missing from your purse!

DETROIT -- Prostate cancer is the most frequent and second deadliest cancer men face. A team of Wayne State University researchers recently received $363,660 from the National Cancer Institute of the National Institutes of Health for the project "Bone-induced c-kit in prostate cancer cells: implications for bone metastasis" that aims to shed new light on implications for bone metastasis in prostate cancer.

As cancer grows in the prostate, cancerous cells can enter the bloodstream and spread to other parts of the body, particularly into the bones. These metastases are the primary cause of death in prostate cancer patients. Current treatments available for prostate cancer with bone metastases can only slow the growth of cancer cells or relieve symptoms.

According to R. Daniel Bonfil, Ph.D., associate professor of urology and pathology in WSU's School of Medicine and principal investigator of the project, the mechanisms by which prostate cancer cells take root and start growing once they become lodged in the bones are not well understood. In addition, Bonfil stated that cells respond to specific signals, or ligands, coming from the tissue where they are located through receptors usually expressed on their surface. When these receptors are activated by their specific ligands, changes in cell behavior occur.

"Our research aims to investigate the contribution of a receptor known as c-kit in the metastasis of prostate cancer to the bone," said Bonfil. "Through our previous research, we have reported for the first time that the expression of the c-kit receptor is augmented in bone metastasis of prostate cancer patients. We also observed that while c-kit is not produced in prostate cancer cells grown alone outside the body, the expression of the receptor is specifically turned on in the same cells when they contact bone cells either in vitro or in vivo, which implies a role for c-kit and its ligand in prostate cancer bone metastasis."

Bonfil and Hyeong-Reh Choi Kim, Ph.D., professor of pathology in WSU's School of Medicine, hypothesize that factors derived from the bone stimulate the production of c-kit and its ligand in prostate cancer cells, facilitating the growth and survival of metastatic cells to the bone, causing them to be less susceptible to chemotherapy.

Through genetic engineering, the team will modify the prostate cancer cells so they fail to produce c-kit. They will compare the growth of these cells within bone to control prostate cancer in which c-kit induction occurs, with the goal of determining the contribution of c-kit to bone metastasis. In addition, they will study the role of c-kit resistance to chemotherapeutic treatment.

"We anticipate that our research will shed light on a novel biological mechanism involved in bone metastasis, providing the foundation for the development of new tailored treatments that will eliminate morbidity and mortality due to this common complication in prostate cancer patients," said Bonfil.

A University of Arizona geotechnical engineer has been awarded $1.25 million to conduct research that could provide safer working conditions for miners and construction workers.

A University of Arizona College of Engineering research program looking at new methods of determining rock strength could reduce hazardous working conditions that currently cause thousands of deaths every year in mining and construction.

Pinnaduwa H. S. W. "Kumar" Kulatilake, professor of geological engineering in the UA Department of Mining and Geological Engineering, is the sole principal investigator for a five-year project to develop new methods of assessing ground stability. The National Institute for Occupational Safety and Health (NIOSH), which is part of the Centers for Disease Control and Prevention, is funding the research.

The true extent of mining fatalities globally is hard to gauge, but some estimates suggest that as many as 12,000 miners die every year in mine accidents. The primary cause of these fatalities is ground failure.

Ground failure is generally any significant movement of the ground, such as a landslide or underground excavation collapse, or when ground moves and flows like a liquid, which results when earthquakes or high water pressure cause soil to lose its strength.

Tunnel or underground cavern collapse and catastrophic failure of slopes, dams and foundations are examples of ground failure encountered in mining and civil engineering projects. Part of the problem is that current methods of rock assessment are simply not up to the task of providing a detailed picture of what engineers are truly getting into when they start blasting and tunneling.

During the five year project, Kulatilake will extend rock strength criteria he has developed to make them applicable in three-dimensions. He will be working with two mines in the U.S. and two mines in China to apply these new methodologies to underground and surface excavations to determine how well they work in the real world. China's official mining death toll in 2010 was 2,631. It is the world's largest coal producer and consumer, and employs 5.5 million coal miners.

Kulatilake points out that it is not only miners who will benefit from being able to evaluate rock masses for potentially hazardous working conditions. "This is not only for mining," he said. "This work also relates to civil rock engineering projects such as tunnels, caverns, foundations, dams, and slopes."

To develop new methods of ground stability analysis, Kulatilake will combine field investigations and extensive laboratory testing, such as CT scans and three-dimensional load testing, with three-dimensional numerical modeling, including new theoretical concepts and advanced statistical and probabilistic procedures to quantify variability and uncertainty.

His theoretical models will be made increasingly accurate over time as their predictions are validated using lab test results and field data. In essence, Kulatilake aims to bring more certainty to what is essentially educated guesswork when it comes to assessing ground stability. "We have been using very simple methodologies in practice to address very complicated problems," he said.

The research findings will be incorporated in graduate courses taught by Kulatilake in the department of mining and geological engineering and the department of civil engineering and engineering mechanics. And his teaching will extend beyond the University of Arizona: During the last 20 years he has taught 52 short courses all over the world.

"Kumar" Kulatilake, professor of geological engineering in the UA Department of Mining and Geological Engineering, is the sole principal investigator for a five-year project to develop new methods of assessing ground stability. The National Institute for Occupational Safety and Health (NIOSH), which is part of the Centers for Disease Control and Prevention, is funding the research.

The true extent of mining fatalities globally is hard to gauge, but some estimates suggest that as many as 12,000 miners die every year in mine accidents. The primary cause of these fatalities is ground failure.

Ground failure is generally any significant movement of the ground, such as a landslide or underground excavation collapse, or when ground moves and flows like a liquid, which results when earthquakes or high water pressure cause soil to lose its strength.

Tunnel or underground cavern collapse and catastrophic failure of slopes, dams and foundations are examples of ground failure encountered in mining and civil engineering projects. Part of the problem is that current methods of rock assessment are simply not up to the task of providing a detailed picture of what engineers are truly getting into when they start blasting and tunneling.

During the five year project, Kulatilake will extend rock strength criteria he has developed to make them applicable in three-dimensions. He will be working with two mines in the U.S. and two mines in China to apply these new methodologies to underground and surface excavations to determine how well they work in the real world. China's official mining death toll in 2010 was 2,631. It is the world's largest coal producer and consumer, and employs 5.5 million coal miners.

Kulatilake points out that it is not only miners who will benefit from being able to evaluate rock masses for potentially hazardous working conditions. "This is not only for mining," he said. "This work also relates to civil rock engineering projects such as tunnels, caverns, foundations, dams, and slopes."

To develop new methods of ground stability analysis, Kulatilake will combine field investigations and extensive laboratory testing, such as CT scans and three-dimensional load testing, with three-dimensional numerical modeling, including new theoretical concepts and advanced statistical and probabilistic procedures to quantify variability and uncertainty.

His theoretical models will be made increasingly accurate over time as their predictions are validated using lab test results and field data. In essence, Kulatilake aims to bring more certainty to what is essentially educated guesswork when it comes to assessing ground stability. "We have been using very simple methodologies in practice to address very complicated problems," he said.

The research findings will be incorporated in graduate courses taught by Kulatilake in the department of mining and geological engineering and the department of civil engineering and engineering mechanics. And his teaching will extend beyond the University of Arizona: During the last 20 years he has taught 52 short courses all over the world.

Country music great Haggard hospitalized with pneumonia (Reuters)

NASHVILLE, Tenn (Reuters) ? Country music great Merle Haggard has been admitted to a Georgia hospital suffering from pneumonia and postponed the rest of his concert dates in January, his spokeswoman said on Wednesday.

Haggard, 74, entered the Macon hospital on Tuesday night after he canceled a show in that Georgia city seven minutes before he was to take the stage because he was too ill to perform, said Frank Mull, his tour manager and close friend.

A member of the Country Music Hall of Fame, Haggard is best known for songs including "Mama Tried," "Okie from Muskogee" and "The Fightin' Side of Me."

Haggard had been scheduled to perform again on Wednesday night in Columbus, Georgia, but that show and the rest of the January slate will be rescheduled for April, according to Haggard's Los Angeles-based publicist Tresa Redburn.

Redburn said the singer was receiving fluids intravenously. She said she spoke with Haggard by telephone "and he sounded pretty good."

Haggard will take time off to recover and resume his tour in February, Redburn said. Haggard lives in Northern California.

The singer was unwell when he left his California home to begin the tour, but did not want to disappoint his fans, Mull said. "He thought he was well enough to work and he did work three dates, and he got progressively worse," Mull said.

With influences ranging from Lefty Frizzell to Bob Wills to Jimmie Rodgers, Haggard is an architect of country music's "Bakersfield Sound."

Costa Concordia Cruise Ship Audio: Recording Alleges Francesco Schettino, Captain, Refuses To Return To Ship (AUDIO)

A recording of a telephone conversation between Francesco Schettino, the captain of the Costa Concordia cruise ship, and Gregorio De Falco, a captain in the Italian coast guard, has been released, revealing that the coast guard captain ordered Schettino several times to return to the ship he allegedly abandoned after it ran aground and capsized near the island of Giglio, Italy on Friday.

In the recording, which The New York Times reports was made at 1:46 a.m. Saturday morning, De Falco orders Schettino, who says he is "with the rescue boats," to get back on board to tell him how many people remain on the doomed ship.

More than 4,000 people were on board before it crashed.

"Listen Schettino," De Falco says, according to a transcript of the recording from the Associated Press. "There are people trapped on board. Now you go with your boat under the prow on the starboard side. There is a pilot ladder. You will climb that ladder and go on board. You go on board and then you will tell me how many people there are. Is that clear? I'm recording this conversation, Cmdr. Schettino..."

Schettino replies, "In this moment, the boat is tipping..." before the coast guard commander cuts him off, repeating the order to return to the ship, and adding "Listen Schettino, that you saved yourself from the sea, but I am going to... I'm going to make sure you get in trouble. ...I am going to make you pay for this. Go on board, (expletive)!"

Schettino replies, "Commander, please..." before the coast guard captain again interrupts him, pleading with him to return to the ship.

"Are you refusing to go aboard commander?" De Falco asks moments later. "Can you tell me the reason why you are not going?"

"I am not going because the other lifeboat is stopped," Schettino replies.

"You go aboard. It is an order," De Falco says. "Don't make any more excuses. You have declared 'abandon ship.' Now I am in charge. You go on board! Is that clear? Do you hear me? Go, and call me when you are aboard. My air rescue crew is there."

Survivors described confusion and chaos as passengers and crew tried to escape the ship. Some have accused the crew of abandoning ship before the passengers.

Two Italian newspapers reported that Schettino went to shore and called a taxi to get away from the wreck.

He is being investigated on charges that include manslaughter the AP reports and has been placed under house arrest pending any trial.

According to the BBC, the death toll from the Costa Concordia has now risen to 11. Twenty-nine people are still reported missing.

Samsung says to merge bada mobile OS with Intel-backed Tizen (Reuters)

SEOUL (Reuters) ? Samsung Electronics Co said on Tuesday it planned to merge its 'bada' mobile software with a platform backed by chipmaker Intel Corp in its latest push to diversify away from Google's Android.

Samsung, which emerged as the world's biggest smartphone manufacturer on the back of booming Android models in the third quarter, joined forces with Intel last year to strengthen its mobile software push.

In September two Linux software groups, one backed by Samsung, and another by Intel, agreed to jointly develop Tizen, a new operating system for cellphones and other devices, by merging their LiMo and Meego platforms in a bid to gain wider industry and consumer support.

"We have an effort that will merge bada and Tizen," a Samsung spokesman confirmed senior vice president Kang Tae-jin as telling Forbes magazine in an interview last week.

The open-source Tizen platform supports multiple devices including smartphones, tablets, Internet-enabled TVs, netbooks and in-vehicle infotainment systems.

It would have to attract wide support from developers and manufacturers to compete with the dozen or so other mobile operating systems available in a smartphone market dominated by Google's Linux-based Android and Apple's in-house software.

Google's Android accounted for 53 percent of the global smartphone market in the third quarter and Samsung's bada platform just 2.2 percent.

(AP) ? The editor of Britain's Daily Mirror newspaper told a media ethics inquiry Monday it is possible illegal phone hacking took place at the tabloid, which was edited for almost a decade by CNN celebrity interviewer Piers Morgan.

The editor of sister title the Sunday Mirror told the same tribunal that she couldn't be sure illicit eavesdropping hadn't gone on there, too ? but the papers' publisher said the company had no plans to launch an internal investigation into possible wrongdoing.

Mirror editor Richard Wallace had told the inquiry earlier that hacking "might well" have been going on at the Mirror in the early 2000s.

But he said he had no knowledge of it and insisted "ethical issues are embedded" within the culture of the paper's newsroom.

The judge-led inquiry into press standards was set up in the wake of revelations that Rupert Murdoch's now-shuttered News of the World had illegally eavesdropped on the voice mails of celebrities, politicians and even crime victims in its quest for scoops. Some alleged victims have accused other newspapers outside the Murdoch empire of wrongdoing, too.

Comments made by Morgan have raised suspicions that phone hacking may have been going on while he was in charge of the Daily Mirror.

Morgan told an earlier session of the inquiry that he didn't believe he ever listened to hacked voicemail messages while he was editor between 1995 and 2004.

Morgan told the committee his earlier comment that "loads of newspaper journalists were doing it" was based on rumor and hearsay.

But Morgan refused to explain how he had heard a voicemail message left by former Beatle Paul McCartney on the phone message system of McCartney's now ex-wife Heather Mills.

Morgan's description of the message in a 2006 article for the Daily Mail led some to wonder whether he'd obtained it through phone hacking. Mills has said there was no way Morgan could have obtained it honestly.

Wallace, who took over as editor after Morgan was fired in 2004 for running faked pictures of British soldiers allegedly abusing Iraqis, said he had never heard that message.

He acknowledged "it's possible" that phone hacking was the source of a 2002 story on the romantic life of Sven-Goran Eriksson, then England's national soccer coach.

Tina Weaver, editor of the Sunday Mirror, was asked about a BBC report that claimed phone hacking had gone on "pretty much every day" for a period at the newspaper.

"I don't believe it to be true," she said, but admitted the BBC's claim had never been internally investigated.

Sly Bailey, chief executive of the newspaper's publisher, Trinity Mirror PLC, acknowledged that after a News of the World reporter and a private investigator were arrested for phone hacking in 2006, "lots of journalists were speculating" about the extent of similar wrongdoing at other tabloids.

But she said that at the Mirror titles "there was no evidence and we saw no reason to investigate."

And she said she didn't plan to investigate now.

"I don't think it's the way to run a healthy organization, to go around conducting investigations when there is no evidence," Bailey said.

The still-unfolding hacking scandal has sparked the resignations of several top Murdoch executives, senior police officers and Prime Minister David Cameron's spin doctor, a former News of the World editor.

The inquiry, led by judge Brian Leveson, is hearing this week from editors of daily newspapers and celebrity magazines including Hello! and OK!

Separately, Britain's Justice Secretary Kenneth Clarke suggested journalists may be justified in using illegal practices such as phone hacking, if they are exposing an "extreme wrong" and told a committee of lawmakers that reporters should not be prosecuted for using illegal methods, if the stories they are reporting are in the wider public interest

"There are some cases where journalists are justified in going to the limits," Clarke said. "Normally I do not think they should obtain stories by bribery, by blackmail or by phone-tapping... Just occasionally they do that because they are investigating extreme wrong."

He pointed to the exposure of lawmaker expense scandals and cricket spot-fixing by journalists as cases where it's possible illegal tactics were used to gather information.

"I don't know how they got the information about the House of Commons expenses, but it is quite possible that they bribed somebody to get hold of the information," Clarke said. "I really don't know that. It was a very good thing that it was got from somewhere and the public interest was being served."

Either TI has the hots for Arduino in a big way, or its latest wireless charging kit isn't quite ready for mass production. When it does arrive, however, it promises to do away with those cumbersome specialized sleeves and back covers that are currently needed for inductive charging. Instead, it'll deliver efficient in a package that's small enough to be installed as part of a device's internal circuitry. In addition to the Qi-standard 5W version we glimpsed a while back, the company is also working on a 10W variant for the iPad 2 and other tablets, which could wipe the smile off LaunchPort's face and perhaps make MicroUSB 3.0 superfluous before it even gets here.

INDIANAPOLIS (AP) ? NCAA President Mark Emmert would like to erase all the tawdry tales from his first full year in office.

On Thursday, Emmert asked university leaders to help him turn the page on a disastrous 2011 that included a child sex abuse scandal at Penn State that overshadowed NCAA violations at a handful of major football programs.

Emmert wants to restore some of college sports' core principles -- choosing education over money, amateurism over professionalism and abiding by the rules rather than ignoring them.

"What we have to do is work together to act on those values, to let the world know which fork in the road we've taken so we don't have the same story line this year that we had last year," he told about 2,000 delegates at the annual convention, just a few blocks from the NCAA headquarters. "I know we can do it. We can do it in 2012."

For roughly 30 minutes, Emmert again expressed frustration with the rash of infractions charges, alleged ethical breaches and possible criminal conduct in 2011.

And Emmert made it perfectly clear how upset he was by striking a far different tone Thursday than he did in his first state of the association address last year in San Antonio, Texas.

There, Emmert paraded "model" student-athletes across the stage, a production that even included eventual Heisman Trophy winner Robert Griffin III.

This time, speaking sternly and with few laugh lines, Emmert broadly recounted some of the most damaging phrases he'd heard: College sports is about winning at all costs, it's all about the money, everybody cheats and the term student-athlete is an oxymoron.

"I've heard people say that there are no ethics and no integrity in college sports and the whole system is broken. But here's the really bad news. There's truth in some of those criticisms," Emmert said. "What parts of those stories are true? Sometimes we have seen behaviors that don't match our values. We do have some people that want to win at all costs. We have some student-athletes that don't care about getting an education and some that simply don't get the education they deserve. The worst thing to me is that they completely overshadow all of the good things that are going on in intercollegiate athletics."

The push for change has already begun.

In October, the Division I Board of Directors approved rules giving conferences the option of paying an additional $2,000 toward athletes' living expenses and multi-year scholarships that could end the practice of coaches stripping away financial aid based solely on athletic performance.

Both rules have become targets of override measures, and the board is scheduled to consider modifications Saturday. Emmert expects both rules to withstand the challenges, though the stipend could face some modifications.

The NCAA also has approved tougher academic standards, which could lead to postseason ineligibility. Under the new guidelines, last year's men's basketball national champion Connecticut would have missed the tournament and also is likely to miss the tourney next year.

Some say the academic reforms still are not tough enough.

"I don't believe the academic reforms are anything more than a P.R. move because there are too many loopholes in it," said Ohio University professor David Ridpath, past president of an NCAA watchdog called The Drake Group.

On Wednesday, the Legislative Council also passed a proposal that would tighten the definition of an agent to include third parties. That would eliminate the loophole that allowed Cam Newton to retain his eligibility even after the NCAA determined Newton's father attempted to shop his son's services.

The rule could be approved Saturday.

"I think it's a great start," he said. "It will go to the board, and I think they'll put in place, and we'll see if we get the change we want. If not, we'll change it."

It's only a start.

On Friday, the NCAA has carved out a three-hour session to brief delegates about tougher penalties for infractions, a three-tiered new penalty structure, a quicker enforcement process and the rewriting of the massive 400-plus page rulebook.

Regardless of the changes sure to come in 2012, Emmert and others within the organization understand this process can only work if university presidents and athletic directors are on board.

"I don't think it has to be sold," vice president of enforcement Julie Roe Lach said. "What I've seen and heard is that there is a collective momentum that we've got to do something. I think the time is ripe for change, and not only is it ripe for a change, there's a need for change."

What can Emmert do?

He wants to make integrity chic again in college sports.

"We need to clarify who is in charge," he said. "University presidents and boards need to be fully in charge. Athletic departments need to be in charge of maximizing revenue. But it's about more than that. If you are part of university environment, your conduct has to be the same as anyone else at that college. Student-athletes have to be able to take advantage of the educational opportunities, and they have to play by the rules. That's not too much to ask, I don't think. And supporters have to understand that just because you're a fan doesn't mean you're in charge."

Emmert also awarded the organization's President Gerald R. Ford Award to Tennessee women's basketball coach Pat Summit, who could not attend Thursday because her team was playing at Kentucky.

Joan Cronan, Tennessee's women's athletic director, accepted the award on Summitt's behalf following a short video recounting the Hall of Fame coach's contributions to the game.

"I am truly humbled to receive an award named after a man who led this country as the 38th president," Summitt said at the end of the video. "As a head coach, I have a daily responsibility to make sure our Lady Vol players are students first and athletes second and I do that every day in words and in actions. I tell them they are at Tennessee to earn a degree. I love teaching the game and I love teaching life skills. I accompany that with the phrase that the gym is my classroom, and along the way we've been fortunate enough to win a few games, too."
